Can I buy my home?The RTB regulations changed in January 2005.
For any tenancy commencing on or after 18th January 2005, the qualification period is now 5 years.
Where there has been an exchange or transfer to a current address the two year rule would still apply, as long as the previous tenancy commenced before 18th January 2005.
If the spouse, partner or parent was previously the tenant, you would not have been considered as a secure tenant and you would not be able to apply to purchase if the tenancy was transferred after 18th January 2005. You would however be able to use the period when you lived with your spouse, partner or parent for discount purposes.
The period in which a property can be sold after purchasing is extended from 3 to 5 years.
If you decide to sell within 10 years, must now first offer it to the landlord at market value.
