Who has the right to succession?When a council tenant dies the tenancy may be passed on to a 'qualified' successor. A request for succession must be submitted in writing by the spouse, or by a member of the tenant’s family who has lived with the tenant during the twelve months up to the tenant’s death.
Only one succession is allowed, so if the deceased tenant succeeded to the tenancy on the death of the previous tenant, his/her successors are not qualified to succeed.
We will request that the death certificate is supplied, which determines the date at which the tenancy is succeeded, although no new tenancy agreement is required, since the successor takes over the original tenancy automatically under the statutory provisions.
