Illegal Eviction The legislation protecting occupiers against illegal eviction is the Protection from Eviction Act 1977. It is a crime for a landlord or agent to harass or illegally evict a tenant so that they cannot occupy their home. It is often accompanied by racial or sexual harassment and tends to affect those on low incomes and shorthold tenants. Much goes unreported as tenants are either frightened or think it is pointless to complain. In fact the evidence shows that if a landlord has attempted to remove a tenant without following the legal requirements and they are challenged then conviction is quite likely. In Merthyr we have very few reported cases of harassment and they are usually resolved promptly and the tenant allowed to return to their home.
