The National Highways definition of the Local Road Network is that portion of the Road Network for which a Local Government is responsible, and is eligible for funding from the State Government to operate and maintain. If MTCBC highways inspections are all up to date we will not compensate the driver by defending the Council under Section 41 Highways Act 1980 and therefore rely on the statutory defence contained within Section 58 of the same Act.
