Environmental Information Regulations 2004 Ffos-y-Fran water pollution 1. Please confirm that you hold the following and provide us with copies electronically: a. All documents and correspondence between Merthyr (South Wales) Limited and Merthyr Tydfil County Borough Council, concerning the potential for water pollution related to turning off the pumps at the Ffos-y-Fran Land Reclamation Scheme, from July 2023 to date. b. A list of all such items (as set out in paragraph (a) above), if you decide to refuse disclosure of any of the above items of requested information. c. EIR provisions and guidance: 2. The information requested at paragraph 1 above qualifies as “environmental information” under EIR r.2(1) and for the purposes of the EIR because it is “information relating to waste, discharges and other releases into the environment, affecting or likely to affect the elements of the environment” (r.2(1)(b)) such as “water” (r2(1)(a)). 3. We also note that public authorities are strongly encouraged to comply with the “Code of practice on the discharge of obligations of public authorities under the Environmental Information Regulations” and the “Section 46 code of practice” which outline the obligations of public authorities to include providing assistance and/or advice to information requesters. If you do not hold the information requested, please confirm that fact. In that instance, please advise of any other public authority that may hold this information, in accordance with your duty under EIR r.9(1) to provide advice and assistance.
