Re: Mine at Ffos y Fran 1. The Company that currently own the mine at the time of purchase contracted legally to renovate the site and surrounding landscape following cessation of mining and expiry of the contract to do so . What steps have been taken to enforce this contractual obligation ? 2. Do you set time limits to fulfil this contractual obligation ? 3. Whilst the current company have owned the Mine have you taken any affirmative legal action against them for any environmental breaches or any failures to satisfy other contractual obligations ? 4. There are a couple of Race Tracks that have been carved out of the landscape within the curtilage of the mine , was permission necessary for construction of the same and if yes was it obtained ? 5. In the event re (4) above that the race tracks and supporting activities are illegal what steps have your Council taken to curtail the same and what legal action if any have you taken ? 6. I note that the owner of the mine David Stanley Lewis has a conviction for fraud (£88,000) in 2003 and recently assaulted an elderly solicitor Robert Davies at his Offices in Newport. On conducting further research I have noted that Lewis has formed a company in the name of a Solicitor employed by you which is called the Geraint Morgan Legacy Ltd clearly trying to make a mockery of Mr Morgan who I assume has had previous dealings with Mr Lewis that I presumably became litigious but please confirm and clarify whether any attempts to change the Company name were made by the Council ? 7. Following the expiry of the contract to mine the coal did Lewis continue for another year to extract coal ? I understand he did and if that is the case did the Council take any enforcement action against the Company that own the mine ? 8. If that extra year which on the face of it appears to have been illegal what attempts if any have been made to seize the profits associated with the additional coal mined which from a cursory glance at the companies accounts runs into millions of pounds. 9 . Have Merthyr ever had an elected councillor called Bernard Llywellyn? 10. If the answer to (9) above is yes when was he elected and when did his term in office end ?

What steps have been taken to enforce this contractual obligation? The Council is not aware of any legal contract for the landowner to restore the site. The restoration of the site is a requirement of the planning conditions imposed on the planning permission. 2. Do you set time limits to fulfil this contractual obligation? N/A there are no contractual obligations. However, there are conditions imposed within the planning permission which sought the restoration of the site. 3. Whilst the current company have owned the Mine have you taken any affirmative legal action against them for any environmental breaches or any failures to satisfy other contractual obligations ? The Council has not taken any legal action in respect of environmental breaches. Legal action has been undertaken in respect of breaches of the escrow account agreement and the community fund agreement. 4. There are a couple of Race Tracks that have been carved out of the landscape within the curtilage of the mine, was permission necessary for construction of the same and if yes was it obtained? Planning permission is required for the construction of the racetrack. A planning application has not been submitted. 5. In the event re (4) above that the race tracks and supporting activities are illegal what steps have your Council taken to curtail the same and what legal action if any have you taken? The construction of the race tracks is not deemed to be illegal but it is an unauthorised development that may be subject to enforcement action. 6. The Council has no control over the naming of companies and the Council has not sought to have the name of the company changed. 7. I understand he did and if that is the case did the Council take any enforcement action against the Company that own the mine? Coal extraction at the mine was expected to cease by September 2022. The coal extraction did continue beyond this date in order to address ground stability concerns that remained. Enforcement action was reviewed and an enforcement notice was issued in May 2023, which required the cessation of coal extraction. This was subsequently appealed to PEDW (Planning Environment Decision Wales) by the landowner. Coal extraction later ceased in November 2023 in compliance with the enforcement notice and the appeal was later withdrawn. 8.
