1. Statutory Status of Phase C

Please confirm:

a) Whether the document titled “Record of EP Involvement” (Phase C) is used as the Educational Psychology advice relied upon for the purposes of preparing, maintaining or reviewing an Individual Development Plan (IDP) under the Additional Learning Needs and Education Tribunal (Wales) Act 2018.

b) If not, please provide the template or format used when Educational Psychology advice is provided specifically for statutory IDP purposes.

c) Please provide any document that defines the distinction (if any) between:

• A consultation record,

• EP advice,

• Statutory EP assessment,

• EP advice for Tribunal purposes.

2. Phase Model Governance

Please provide copies of any documents that describe, govern or explain:

a) The criteria for movement between Phase A, Phase B and Phase C.

b) Who has authority to decide whether a case progresses between phases.

c) Whether parents/carers may request progression to Phase C.

d) Any thresholds, triage criteria or service rationing framework applied within the phase model.

Please provide:

a) Any Quality Assurance policy, protocol, checklist or supervision framework applied to Phase C documents.

b) Any document describing who has authority to require amendments to Phase C records prior to issue.

c) Any delegation of authority between Educational Psychologists and non-EP officers in relation to approving, amending or withholding Phase C documents.

The Phase A template includes the statement:

“Please DO NOT photocopy this document or forward to any third party WITHOUT AUTHORISATION from the Educational Psychology Service.”

Please confirm:

a) Whether this restriction applies to parents/carers.

b) The legal basis relied upon for restricting onward disclosure of consultation records where those records inform statutory decision-making.

c) Whether any similar restriction applies to Phase C documents.

Please provide any document that:

a) Describes how professional independence of Educational Psychologists is maintained where advice informs IDPs.

b) Sets out safeguards to prevent alteration of professional opinion by non-EP officers.

a) Whether the document titled “Record of EP Involvement” (Phase C) is used as the Educational Psychology advice relied upon for the purposes of preparing, maintaining, or reviewing an Individual Development Plan (IDP) under the Additional Learning Needs and Education Tribunal (Wales) Act 2018.

Both EP Phase B and Phase C reports are used as the Educational Psychology advice relied upon for the purposes of preparing, maintaining, or reviewing an Individual Development Plan (IDP) under the Additional Learning Needs and Education Tribunal (Wales) Act 2018.

b) If not, please provide the template or format used when Educational Psychology advice is provided specifically for statutory IDP purposes.

c) Please provide any document that defines the distinction (if any) between:

• A consultation record,

• EP advice,

• Statutory EP assessment,

• EP advice for Tribunal purposes.

There is no document that defines the distinction between these forms of EP report/information/feedback.

2. Phase Model Governance

a) The criteria for movement between Phase A, Phase B and Phase C. We do not hold documentation that describes criteria for this.

b) Who has authority to decide whether a case progresses between phases. Educational Psychologists work with schools, settings, pupils and their families to decide which phase of EP involvement will be most helpful and appropriate. This can change and develop over time.

c) Whether parents/carers may request progression to Phase C. As above.

d) Any thresholds, triage criteria or service rationing framework applied within the phase model. The EP team meet on a weekly basis at our ‘Reflection and Formulation’ meeting, to discuss cases and any queries about phase of work to best meet pupil, family, and setting’s needs.

We do not hold documentation that describe or governs any QA or approval process applied to EP reports. EPs utilise professional supervision, peer reviewing, and HCPC standards. Trainee EPs complete work under the supervision of an EP who countersigns their reports.

b) Any document describing who has authority to require amendments to Phase C records prior to issue. As above.

c) Any delegation of authority between Educational Psychologists and non-EP officers in relation to approving, amending, or withholding Phase C documents. There is no delegation of authority between EPs and non-EP officers in relation to EP reports.

b) The legal basis relied upon for restricting onward disclosure of consultation records where those records inform statutory decision-making. The lawful basis applies to the processing of the personal data and not the restriction to create additional copies, this would be imposed to preserve the confidentiality of those documents.

c) Whether any similar restriction applies to Phase C documents. Yes
