It is regarding the escrow account held on behalf of Merthyr Tydfil County Borough Council and Merthyr (South Wales) Limited in relation to Ffos-y-fran land reclamation scheme, opencast coal mine restoration.

I request the most up-to-date and detailed breakdown that can be released, showing:

a) how much money remains in the escrow account

b) how much has been spent out of the escrow account, and on what work packages

c) details of any remaining, uncompleted work packages yet to be funded and their projected cost

Guidance:

I would recommend initially approaching Mr. David Cross in MTCBC Planning, Mr. Hugh Towns, Minerals Planning, Carmarthen and MTCBC, and Mr. Geraint Morgan in Legal services for this information, or reviewing what minutes may exist of the regular Technical Working Group (TWG) meetings on Ffos-y-fran.

For clarity, I am referring to the £15 Million surety, or security bond money held in an escrow account on behalf of Merthyr Tydfil County Borough Council and Merthyr (South Wales) Limited, relating to the Ffos-y-fran Land Reclamation Scheme

I believe that the ongoing work attracting the escrow payments is being described as phases 2A and 2B of the existing, original planning consent for the Ffos-y-fran Land Reclamation Scheme, but is also being more popularly termed 'Interim Restoration' work. It is my understanding that this is being delivered as a discrete set of work packages.

If the cost cap is engaged by this request, please fulfil it in the order set out up to the cost cap, and provide a breakdown of exactly how the request, in full would exceed the cost cap. As you will be aware, the grounds of a refusal will be considered and may be challenged up to the level of ICO.
