Re: Relating to waste related offences and enforcement actions undertaken by Merthyr Tydfil County Borough Council.
1. Enforcement actions taken by Merthyr Tydfil County Borough Council for waste offences between 1 January 2016 and 31 December 2025
For all waste related offences investigated or enforced by Merthyr Tydfil County Borough Council between 1 January 2016 and 31 December 2025. As part of this request, please could you provide the following details for each case:
• Relevant legislation used (Act and Section)
• Date of the offence
• Date of the enforcement action
• Type of waste offence (e.g. fly tipping, litter, dog fouling, household waste duty of care, etc)
• Details on the type of waste
• Details on the size of the waste
• Type of enforcement action taken, including but not limited to:
o Fixed Penalty Notice (FPN)
o Warning letter
o Advice and Guidance
o Prosecution
o Caution
o Seizure
o Any other enforcement outcome
• Town and other location details of the offence, including grid reference if recorded
• Details of the offender, to the extent disclosable (e.g., business name if applicable)
• Outcome of the case, including:
o Whether the case was successful or unsuccessful
o Fines, costs, or compensation awarded (if applicable)
• If the case resulted in more than one charge, please specify the number of charges.
If possible, please provide this information in a spreadsheet or machine readable format (e.g., CSV or XLSX).
2. Fixed Penalty Notices issued under section 34 of the Environmental Protection Act 1990
Please provide the number of Fixed Penalty Notices (FPNs) issued under section 34 of the Environmental Protection Act 1990, following the introduction of the Household Waste Duty of Care (Fixed Penalties) (Wales) Regulations 2019. For the period from commencement of the Regulations in 2019 to 31 December 2025, please provide:
• The total number of FPNs issued
• Section of the Act used, (e.g. Section 34(2A))
• If available, a year by year breakdown
• Any recorded information on:
o Locations of offences
o Details of the offender, to the extent disclosable (e.g., business name if applicable)
o Details of any vehicle used, to the extent disclosable (e.g VRM)
o Type of offence (fly tipping, unauthorised carrier, occupier of domestic property)
o Amounts paid
o Number of FPNs withdrawn or cancelled, with reasoning.
