Question

1. A copy of the list of 18 contaminated sites provided by the Council to Friends of the Earth Cymru in response to their 2024 Freedom of Information request.

2. An explanation of why the Council's public-facing statement states that its contaminated land register "would have no entries," when the Council separately holds a list of 18 identified contaminated sites — and whether the public statement has since been or will be corrected.

3. Confirmation of whether the Council's Contaminated Land Inspection Strategy has been reviewed or updated since the version dated 2011, and if not, the current timetable for review.

4. Of the sites identified, how many have been formally inspected under Part 2A of the Environmental Protection Act 1990 and the Contaminated Land (Wales) Regulations 2012, and how many have been formally determined as "contaminated land."

5. Whether any of the identified sites are located within 250 metres of a school, residential property, or watercourse.


Answer

1) Merthyr Tydfil CBC has not designated any sites a contaminated under Part 2A of the Environmental Protection Act 1990. The 18 sites specified are sites that have been previously identified as potentially contaminated; however these sites have not been designated as contaminated under Part 2A.

2) Merthyr Tydfil County Borough Council has not determined any land as contaminated land under Part 2A of the Environmental Protection Act 1990. Therefore, the Council's contaminated land register contains no entries.

3) The Council's Contaminated Land Inspection Strategy is subject to periodic review. A further review of the Strategy is planned to be updated next year.

4) None of the sites identified have been formally inspected under Part 2A of the Environmental Protection Act 1990 and the Contaminated Land (Wales) Regulations 2012.
