My query arises out of a report that Kent County Council has a Trans Awareness Course on its intranet which, among other things, states that “sex is what appears on the outside of a person…gender comes from the inside”.That "there is no UK law saying men must use male toilets or women female ones." Also, that its staff are warned that “referring to someone using incorrect pronouns” would be a "microaggression." Please advise: 1. Do you have any similar material available on your intranet? Specifically, any training video or other resources which reference transgender issues, pronouns, "microaggressions" or "unconscious bias"? 2. If so, please provide copies of any such materials. 3. What legal advice has been given (if any) as to the accuracy of the claims made in any such training resources given this Supreme Court ruling in April?

Following the UK Supreme Court ruling and proposed code of practice changes, training materials, processes and policies will be reviewed once we have formal guidance published by the Equality and Human Rights Commission (EHRC). The Interim guidance has been included on the Intranet which includes relevant links to the EHRC website. The practical implications following this ruling remain complex and are subject to ongoing discussion. We have an internal pronouns information sheet which states what they are, why they are important and things we can do to support our workforce (attached), which aimed to raise more awareness of pronouns generally. All training materials, policies, information sheets etc will be reviewed following the publication of final guidance by the EHRC. We have released mandatory equalities training which covers the following general information; • Our Council Equalities Vision for Merthyr Tydfil • What is the difference between Equality, Equity, Diversity and Inclusion? • The Equality Act 2010 • Discrimination & Unconscious bias • Our Duties • Worker Protection Act • Ensuring Accessibility and Easy Reads for Everyone • Supporting Our Workforce at MTCBC • Knowledge Check The following has been included within this training under the ‘Protected Characteristics section’ in relation to the UK Supreme Court Ruling; “The Equality and Human Rights Commission (EHRC) has reviewed and updated the code of practice following the UK Supreme Court Ruling on the definition of 'sex' within The Equality Act 2010. This is currently being reviewed, and formal guidance will be published by the EHRC following the consultation” We have undertaken generic unconscious bias training in the past and as stated above, all materials are being reviewed in line with published changes. Our skillshub learning platform library has over 650 online courses. There is a module on gender reassignment discrimination and unconscious bias which refer to general training elements. There are many proposed changes to the code of practice so any training materials will be updated to reflect any updates to legislation. 2. If so, please provide copies of any such materials. Attached internal pronouns poster. Materials are being reviewed in line with formal guidance and code of practice changes. 3. What legal advice has been given (if any) as to the accuracy of the claims made in any such training resources given this Supreme Court ruling in April? Once formal guidance is published by the EHRC, any such changes following reviews will be discussed internally and advice will be sought where relevant.
