MERTHYR TYDFIL COUNTY BOROUGH COUNCIL CAEDRAW ROAD, MERTHYR TYDFIL
(PROHIBITION OF WAITING AT ANY TIME) (PROHIBITION OF LOADING OR UNLOADING AT ANY TIME) (PROHIBITION OF STOPPING AT ANY TIME-CLEARWAYS) (DISABLED PARKING) (PROHIBITION OF WAITING AT ANY TIME EXCEPT TAXIS) (VARIATION) (REVOCATION) ORDER 2023

NOTICE is hereby given that Merthyr Tydfil County Borough Council in exercise of its powers under Sections 1(1) and 2(1) to (3) of the Road Traffic Regulation Act 1984 (“the Act”)(as amended), and all other enabling powers and after consultation with the Chief of Police in accordance with Part III of Schedule 9 of the Act proposes to make the following Order, the general effect of which is described below. The effect of the Order is as follows:-

1. No person shall cause any vehicle to wait at any time on the lengths and sides of lengths of road specified in Schedule 1.
2. No person shall cause any vehicle to load or unload at any time on the lengths and sides of lengths of road specified in Schedule 2.
3. No person shall cause any vehicle to stop or remain at rest at any time on the lengths and sides of lengths of road specified in Schedule 3.
4. No person shall cause any vehicle to wait at any time on the lengths and sides of lengths of road specified in Schedule 4 to this Order. Disabled Person’s vehicles displaying the relevant disabled person’s badge are allowed to wait for 20 minutes, no return within 1 hour.
5. No person shall cause any vehicle to wait at any time other than taxis for 20 minutes, no return within 1 hour on the lengths and sides of lengths of roads specified in Schedule 5.
6. Vary the Orders specified in Schedule 6.
7. Revoke the Orders specified in Schedule 7.
8. Nothing in Articles 1, 2, 4 and 5 shall render it unlawful for emergency service vehicles to wait on the lengths of roads and sides of lengths of roads specified ‘therein’. Vehicles are allowed to wait for the purposes of building and roadworks, for maintenance, improvement, reconstruction, inspection or survey of the lengths of roads and sides of lengths of roads and the maintenance of essential services. Vehicles are allowed to wait for the purposes of boarding, alighting, weddings, funerals and the delivery of postal packets by vehicles of the service of the Post Office.
9. Nothing in Articles 1, 4 and 5 shall render it unlawful for vehicles to wait on the lengths of roads and sides of lengths of roads specified ‘therein’ for the purposes of loading and unloading.
10. Nothing in Article 1 shall render it unlawful for disabled persons’ vehicles displaying the relevant disabled persons badge to wait for up to three hours (with a return prohibited within one hour) on the lengths of roads and sides of lengths of roads specified ‘therein’.
11. Nothing in Article 3 shall apply:-
(i) to anything done with the permission or at the direction of a Police Officer in Uniform.
(ii) to a vehicle being used for ambulance, fire or police purposes in relation to an emergency or whilst in pursuit of duties or police purposes if the observance of that provision would be likely to hinder the use of that vehicle for the purpose for which it is being used on that occasion.
12. Nothing in Article 3 shall make it unlawful to cause or permit a vehicle to wait in a restricted road for so long as may be necessary to
enable the vehicle
a) if it cannot conveniently be used for such purposes in another road to be used in connection with
i) the removal of any obstruction to traffic
ii) the maintenance, reconstruction or improvement to the length of road
iii) the laying, erection, alteration or repair in or near any of the lengths of road of a sewer, main pipe or apparatus for the supply of gas, water, electricity or telecommunications apparatus as defined in schedule 2 of the Telecommunications Act 1984
b) if it cannot conveniently be used in another road to be used in the service of a local authority or a water authority in pursuance of statutory powers or duties
c) to be used for the purpose authorised by and described on a dispensation or permit issued by the issuing authority provided such dispensation
or permit is clearly visible through the windscreen of the vehicle on the dashboard.
13. For the avoidance of doubt a disabled persons’ vehicle is not permitted to wait or stop in any length of road referred to in article 3.

15. Objections to the Order together with the grounds on which they are made must be made in writing to the undersigned by
31st March 2023.

SCHEDULE 1
PROHIBITION OF WAITING AT ANY TIME

Caedraw Road, Merthyr Tydfil
(i) The eastern side from its junction with Swan Street to a point 8 metres north of the north side of the opposite entrance to Portal House
(ii) The eastern side from a point 11 metres south of the south side of the opposite entrance to Joseph Parry Court for a distance of 44 metres in a southerly direction.
(iii) The western side from its junction with Swan Street for a distance of 240 metres in a southerly direction.
(iv) The northern side of Caedraw Road opposite St. Tydfil’s Court from the eastern side of Caedraw Road for a distance of 49 metres in a north-easterly direction towards Morlais Court and then for a distance of 24 metres in a southerly direction alongside Morlais Court.
(v) The western side of the road opposite Morlais Court from a point 4 metres north of the south side of Morlais Court for a distance of 19 metres in a northerly direction.
SCHEDULE 2
PROHIBITION OF LOADING AND UNLOADING AT ANY TIME
Caedraw Road, Merthyr Tydfil
(i) The eastern side from its junction with Swan Street to a point 8 metres north of the north side of the opposite entrance to Portal House
(ii) The eastern side from a point 11 metres south of the south side of the opposite entrance to Joseph Parry Court for a distance of 44 metres in a southerly direction.
(iii) The western side from its junction with Swan Street for a distance of 240 metres in a southerly direction.
(iv) The northern side of Caedraw Road opposite St. Tydfil’s Court from the eastern side of Caedraw Road for a distance of 49 metres in a north-easterly direction towards Morlais Court and then for a distance of 24 metres in a southerly direction alongside Morlais Court.
(v) The western side of the road opposite Morlais Court from a point 4 metres north of the south side of Morlais Court for a distance of 19 metres in a northerly direction.

SCHEDULE 3
PROHIBITION OF STOPPING AT ANY TIME-CLEARWAYS

Caedraw Road, Merthyr Tydfil
(i) The eastern side from a point 8 metres north of the north side of the opposite entrance to Portal House in a southerly direction to a point opposite the north side of Attlee House.
(ii) The eastern side from a point 12 metres north of the north side of the opposite Entrance to Buckland House in a southerly direction to the south side of the opposite entrance to Glyndyr House.

SCHEDULE 4
DISABLED PARKING ONLY FOR 20 MINUTES, NO RETURN WITHIN 1 HOUR

Caedraw Road, Merthyr Tydfil
The eastern side from the south side of the opposite entrance to Glyndwr House in a southerly direction to a point 6 metres north of the north side of the opposite entrance to Joseph Parry Court.

SCHEDULE 5
PROHIBITION OF WAITING AT ANY TIME EXCEPT TAXIS FOR 20 MINUTES, NO RETURN WITHIN 1 HOUR

Caedraw Road, Merthyr Tydfil
The eastern side from a point 6 metres north of the north side of the opposite entrance to Joseph Parry Court in a southerly direction to a point 11 metres south of the south side of the opposite entrance to Joseph Parry Court.

SCHEDULE 6
VARIATION OF EXISTING ORDERS

Vary the “Merthyr Tydfil County Borough Council Various Roads within the County Borough of Merthyr Tydfil (Variation) (Revocation) Order 2011” by the deletion of schedule 1 item 5 (i), (ii) and (iii).

SCHEDULE 7
REVOCATION OF EXISTING ORDERS

1. Revoke the provisions of the “Merthyr Tydfil County Borough Council (Caedraw Road, Merthyr Tydfil) (Prohibition of Waiting At Any Time) (Prohibition Of Waiting At Any Time Except Limited Waiting For Buses) (Prohibition Of Waiting At Any Time Except Limited Waiting For Taxis) (Revocation) Order 2001”.
2. Revoke the provisions of the “Mid Glamorgan County Council (Caedraw Road, Merthyr Tydfil) (Restriction and Prohibition of Waiting) Order 1978”.
